- On Oct. 4, Judge Immergut issued a temporary restraining order blocking the deployment of 200 members of the Oregon National Guard after Defense Secretary Pete Hegseth asked Oregon Gov. Tina Kotek to activate them, but she refused and the troops were federalized.
- The judge wrote that under Title 10, the deployments exceeded the President's authority, and there was no rebellion or inability to enforce laws in Oregon, Immergut said.
- The Justice Department appealed immediately to the 9th U.S. Circuit Court of Appeals and signaled it would seek a stay while the U.S. Supreme Court may decide by Nov. 17.
- About 40 protesters and half a dozen counterprotesters gathered hours after the ruling, while Oregon Gov. Tina Kotek said Guard members had been away for 38 days.
