Food Importer Sues to Block Trump's 50% Tariffs on Canadian Goods
The complaint says the 96-year-old law was never meant for tariffs and seeks refunds for duties paid on Canadian imports.
- On Tuesday, New Jersey-based Gellert Global Group filed a lawsuit in the U.S. Court of International Trade challenging President Donald Trump's 50% tariffs on Canadian goods, claiming the administration exceeded its authority under the Tariff Act of 1930.
- The Liberty Justice Center argues Section 338 is a "relic of the retaliation-based tariff policy" that was "impliedly repealed" by subsequent legislation, marking the first time the 96-year-old law has been used to impose a tariff.
- "No president should have the power to pull a dormant statute off the shelf," CEO Sara Albrecht said, while senior counsel Jeffrey M. Schwab argued the administration bypassed public comment protections required by the Trade Act of 1974.
- The complaint seeks a court order halting tariff collection and issuing interest-bearing refunds; Thomas Gellert, co-chief executive officer of the group, stated the duties disrupt long-built supplier relationships and create uncertainty across the supply chain.
- This legal challenge occurs amid an ongoing trade war between the U.S. and Canada, as The Liberty Justice Center is currently engaged in two other lawsuits contesting what it describes as the administration's misuse of various statutes to impose sweeping tariffs.
