GOP Proposes Bill to Criminalize Overstaying Visas Following Boulder Attack
- Mohamed Sabry Soliman, an Egyptian national who overstayed his B2 visa, attacked Jewish residents at a pro-Israel rally in Boulder, Colorado, in June 2025.
- The attack prompted Republican Sen. Jim Banks to introduce the Visa Overstay Penalties Act to criminalize visa overstays, linking the incident to national security concerns.
- Soliman legally entered the U.S. In August 2022 on a B2 tourist visa, which lapsed in February 2023, and although he applied for asylum the previous September, he stayed in the country without legal authorization.
- The proposed bill would make remaining in the U.S. Beyond the authorized visa period a federal offense, subject to penalties including fines up to $1,000 and imprisonment ranging from six months to two years, a change from current law.
- Acting ICE Director Todd Lyons announced an increased focus on locating and removing individuals who have remained in the country beyond the expiration of their visas, aiming to prevent potential security risks as part of enhanced immigration enforcement measures.
