US Supreme Court Expands Second Amendment Rights, Eyes More Gun Cases
The justices’ rulings strengthen gun-rights claims and could influence whether more restrictions survive future constitutional review.
The Supreme Court has further expanded the Constitution's Second Amendment right "to keep and bear arms," as justices consider taking up additional gun rights cases for their next term.
Under a landmark decision, the court requires gun control measures to be "consistent with" historical tradition, a standard that has made it increasingly difficult for legislatures to create gun regulations.
In an 8-1 ruling, justices upheld a federal law that makes it a crime for people under domestic violence restraining orders to have guns, the only law to survive the recent legal test.
Gun rights advocates, including the National Rifle Association, expressed hope the court will address state restrictions on rifles and large-capacity ammunition, as some justices have shown interest in hearing such challenges.
Legal experts argue the court's doctrine has elevated the Second Amendment right "far above a first-class right," allowing the judiciary to thwart the will of legislatures by prioritizing gun access.
