Head of nursing at NHS Fife 'can't recall' risk assessment behind Sandie Peggie's suspension

VICTORIA HOSPITAL, KIRKCALDY, FIFE, SCOTLAND, JUL 17 – The head of nursing at NHS Fife cannot recall the risk assessment behind nurse Sandie Peggie's suspension after allegations of bullying, harassment, and patient care concerns.

  • On Christmas Eve 2023 at Victoria Hospital in Kirkcaldy, Fife, nurse Sandie Peggie was placed on special leave then suspended after Dr Beth Upton alleged bullying, harassment and patient care concerns.
  • In her testimony on Wednesday, Gillian Malone said she had no role in the investigation, had never met Sandie Peggie and could not recall seeing the risk assessment compiled by Esther Davidson that led to the suspension.
  • On Thursday, Gillian Malone said she viewed the January 3, 2024 Datix report on the Christmas Eve incident as `a discriminatory allegation`, adding she found the confrontation with the medic `unacceptable` and that such behaviour could warrant formal investigation.
  • Following her suspension, NHS Fife cleared Ms Peggie of the accusations, despite her lodging a claim under the Equality Act 2010 alleging sexual harassment and discrimination.
  • Going forward, the tribunal will decide whether Ms Peggie’s suspension was justified by safety concerns or, as KC Naomi Cunningham argued, by her gender critical objection, with the case hinging on alleged discrimination over her beliefs.
