Ban trans women from single-sex spaces, equality watchdog to say
UNITED KINGDOM, AUG 8 – The Equality and Human Rights Commission will align its guidance with a Supreme Court ruling defining women by biological sex, affecting public service access for transgender women.
- The UK’s equalities watchdog is expected to issue new guidance this month that will prohibit transgender women from accessing female-only areas in public services nationwide.
- This guidance is being developed in response to the UK Supreme Court's April decision, which interpreted the terms "woman" and "sex" in the Equality Act as referring to biological sex, and the EHRC is required to align its guidance accordingly without conflicting with that ruling.
- The rules will apply to organizations offering public services including schools, hospitals, shops, prisons, NHS trusts, gyms, and government departments, while allowing birth certificate checks and inquiries into birth sex.
- The EHRC received over 50,000 consultation responses analyzed using supervised AI and legal experts, despite campaigners accusing the commission of ignoring trans perspectives and questioning the speed of analysis.
- The guidance could lead to legal challenges from trans rights groups, and after ministerial approval by Bridget Phillipson, it will face parliamentary scrutiny and possibly court hearings later this year.
