Delhi HC allows terror accused J&K MP Engineer Rashid to attend Parliament session ‘in custody’ under police escort

  • On Tuesday, the Delhi High Court, comprising Justices Chandra Dhari Singh and Anup Jairam Bhambhani, permitted jailed Baramulla MP Abdul Rashid Sheikh, also known as Engineer Rashid, to attend the ongoing Budget Session of Parliament, scheduled from March 26 to April 4, while remaining in custody and under police escort.
  • Rashid, who has been in Tihar Jail since 2019 following his arrest by the NIA in connection with a 2017 terror-funding case under the UAPA, had his plea for custody parole initially rejected by a trial court on March 10, leading him to appeal to the High Court to attend the Lok Sabha proceedings.
  • Additional Solicitor General Rajkumar Bhaskar Thakare, representing the NIA, opposed the petition, raising security concerns and arguing that Rashid should not be allowed to exploit his MP status to evade imprisonment, while Rashid's counsel, Advocate Hariharan, emphasized Rashid's duty to attend Parliament and cited a previous instance where he was granted custody parole to take his oath on July 5.
  • During the proceedings, the Bench deliberated on imposing conditions, such as preventing Rashid from using a cell phone or interacting with the media, with Justice Bhambhani questioning if security concerns could be addressed through restrictions and asking whether Rashid was a flight risk, while also considering that the speaker and chairman will take care of what happens in the Parliament.
  • The High Court's order specified that Rashid would be taken to Parliament each session day between March 26 and April 4 under police escort and returned to jail after the day's proceedings, with strict restrictions imposed, including prohibiting him from using mobile phones or interacting with the media, but allowing him to meet people within the Lok Sabha premises in relation to his role as an MP, while also noting that the order would not constitute a precedent.
