- The U.S. Department of Justice charged Luis David Nino-Moncada with aggravated assault of a federal officer and depredation of federal property, with his initial court appearance set for 1:30 p.m. on Monday, Jan. 12, 2026.
- During a targeted vehicle stop Thursday, DHS said the driver 'weaponized' his vehicle by striking a Border Patrol car and maneuvering aggressively, prompting an agent to fire.
- There is no video of the shooting, six U.S. Border Patrol agents were present, at least two rounds hit the driver's side window, and Luis David Nino-Moncada and Yorlenys Betzabeth Zambrano-Contreras were shot and later released from hospital into federal custody.
- The FBI is leading a criminal probe with the Bureau of Alcohol, Tobacco, Firearms and Explosives assisting, while Oregon Attorney General Dan Rayfield opened a state investigation and protests led to six arrests after calls from Portland Mayor Keith Wilson to halt ICE operations.
