Umar Khalid's interim bail plea to take care of ailing mother rejected by Delhi court
The court said Khalid's request was unreasonable and noted his father and sister could care for his mother before and after surgery.
On Tuesday, a Delhi court dismissed an interim bail application filed by activist Umar Khalid in the 2020 Northeast Delhi riots conspiracy case.
Khalid, a former Jawaharlal Nehru University student, has been incarcerated since September 13, 2020, facing charges under the Unlawful Activities Prevention Act for allegedly being a "mastermind" of the riots.
Additional Sessions Judge Sameer Bajpai rejected Khalid's 15-day request, ruling that attending the Chehlum ritual was unnecessary and his family could assist his mother before her surgery.
Special Public Prosecutor Ayodhya Prasad opposed the plea, alleging misuse of court leniency; however, on Monday, Justices Nagarathna and Ujjal Bhuyan stated that "bail is the rule and jail is an exception."
The 2020 violence in Northeast Delhi left 53 people dead and more than 700 injured during protests against the Citizenship Amendment Act, fueling ongoing conspiracy allegations.
