In a divided decision, the second chamber gave the reason to the Antofagasta Court of Appeal, which, on 16 May, accepted the application for amparo filed by the psychiatrist.

The Supreme Court confirmed the illegality of the wiretaps to Josefina Huneeus Lagos in the ProCultura case. “The legislator demands a high standard,” the ruling said, stressing that the interceptions violated constitutional guarantees such as the right to privacy.
