- On Tuesday, Oregon Democratic Sen. Ron Wyden requested that the Office of Special Counsel investigate whether Health and Human Services Secretary Kennedy violated the Hatch Act by contacting Iowa Libertarian candidates.
- Wyden alleges Kennedy contacted two Libertarian candidates, Marco Battaglia and Rick Stewart, last month in Iowa and pressured them to suspend their campaigns without federal employee intervention.
- Kennedy allegedly contacted Stewart in his official capacity as a cabinet member to make it easier for the Republican candidate to win and help the Republican Party maintain its House majority, Wyden wrote.
- "Iowa's voters should be able to freely choose who represents them in Congress," Wyden wrote, arguing political appointees cannot intervene by removing candidates from the ballot.
- The Hatch Act prohibits federal employees from participating in political events, a safeguard designed to prevent officials from using their office to influence electoral outcomes and voter choice.
