DHS demands Letitia James take action over New York's refusal to honor ICE detainers

New York's sanctuary policies led to nearly 7,000 criminal foreign nationals being released despite 14,000 ICE detainer requests, including offenders charged with violent crimes, DHS reported.

  • On Monday, the Department of Homeland Security said the State of New York hasn’t honored roughly 14,000 detainer requests, and more than 7,000 current requests are ignored after nearly 7,000 criminals were released this year.
  • New York previously replied that ICE detainer requests won’t be honored, and cashless bail policies have facilitated violent offenders’ release, DHS said.
  • Data show 7,113 aliens in custody with active detainers, and released criminal foreign nationals face charges including 717 assaults, 134 burglaries, 260 sexual offenses, and others.
  • DHS documented cases where ICE officers located and rearrested released offenders, including a repeated reentrant deported last month and convicted sex offenders now deported or in ICE custody.
  • ICE Director Todd Lyons warned in September that noncompliance harms citizens, and federal officials urged New York’s state attorney general to allow cooperation with federal immigration authorities.
