Judge rules ICE repeatedly violated consent decree over ‘warrantless arrests’
A federal judge extended a consent decree after ruling ICE made over 200 warrantless arrests in northern Illinois, requiring better documentation of probable cause.
- On Tuesday, U.S. District Judge Jeffrey Cummings ruled U.S. Immigration and Customs Enforcement violated a 2022 consent decree by making warrantless arrests and extended it until Feb. 2, 2026.
- Plaintiffs allege and demonstrated that ICE used blank I-200 warrant forms, and the judge found violations began at the start of the year and ceased in June.
- Operation Midway Blitz, launched in September, led to more than 1,000 arrests in Chicago, while a Sept. 30 South Shore raid involved roughly 300 officers and Black Hawk helicopters detaining dozens.
- Cummings ordered ICE to release warrantless-arrest data by Oct. 22, start monthly reports with names and identification numbers, rebroadcast that the decree is in effect, and lift conditions for 11 detainees.
- The plaintiffs asked the judge to order immediate release of more than 100 people and to force ICE to better document probable cause, while the NIJC identified over 200 likely violations.
