Where plaintiffs have established that they are likely to succeed in showing (1) that the defendants have a policy or practice of executing third-country removals without providing notice and a meaningful opportunity to present fear-based claims and (2) that such policy or practice constitutes a deprivation of procedural due process, the plaintiffs should be granted preliminary injunctive relief as well as class certification.
