Rental bellies have been an illegal practice in Spain since 2006, when the law on assisted human reproduction techniques came into force; it is also considered a form of violence against women since the reform of the abortion law of 2022, and advertising by agencies involved in it was prohibited with this updating of the norm; when forced, it is also a crime in the European Union since last year.

These babies could be placed in a situation of legal uncertainty if they were not registered, so there was an instruction from the General Directorate of Records and the Notary that determined their conditions of access to the Civil Registry directly.
