Nigeria: Court Sets Aside Judgment Recognising NDC As Political Party

- On Friday, the Federal High Court in Lokoja set aside a December 2025 judgment compelling the Independent National Electoral Commission to register the Nigeria Democratic Congress as a political party. Justice Isah Dashen ordered a fresh hearing after a challenge from the Peace Movement Party .
- Justice Dashen ruled the earlier judgment constitutionally defective because interested parties were not heard in the original proceedings. He declared the omission rendered the process null and void, directing claimants to join all necessary parties for complete determination of the dispute.
- The NDC, which INEC registered on February 5, 2026, insists its ongoing political activities and candidate nominations for the 2027 elections remain valid. The party instructed lawyers to appeal the ruling to the Court of Appeal.
- Counsel for the PMP, Chikezie Ekeocha, stated that the ruling reverses actions taken under the vacated judgment, including the NDC's registration and certificate issuance. He insisted the court directed restoration of the position existing before December 10, 2025.
- The substantive suit will begin afresh with INEC, the PMP, and the NDC as parties to the case. The NDC maintains its participation in the 2027 general elections will continue despite the legal challenge.
