Delhi HC Says Criticism Isn't Personality Rights Violation, Orders Takedown of Five Posts on Raghav Chadha
Justice Subramonium Prasad said the dispute did not yet show a personality rights violation, while ordering removal of five prima facie defamatory posts.
On Wednesday, The Delhi High Court rejected Bharatiya Janata Party MP Raghav Chadha's plea for interim protection of his personality rights, finding no violation at this stage despite AI-generated deepfakes and defamatory social media content.
Chadha, a Rajya Sabha member who recently shifted from the Aam Aadmi Party to the BJP, alleged an orchestrated campaign of malicious deepfakes aimed at his reputation. Senior Advocate Rajiv Nayar argued several posts crossed from political criticism into defamation.
Justice Subramonium Prasad questioned whether such allegations fit within personality rights, observing "there was a distinction between commercialising personality rights and criticism." Political leaders must accept scrutiny regarding their career decisions, the court held.
While the Court dismissed the personality rights claim, it ordered removal of five posts it found prima facie defamatory. The remainder of challenged content was deemed not defamatory at this stage.
The Court previously protected Congress leader Shashi Tharoor's personality rights citing his distinctive speech style, but found Chadha's dispute stemmed from political criticism rather than unauthorized commercial exploitation of his identity.
