Refugees who fail to pass their integration exam on time should not be fined, nor should they have to repay loans for their language lessons, according to the Administrative Jurisdiction Division of the Council of State. The ruling has implications for both the old and new integration laws.
Asylum seekers who fail to pass their civic integration exam within the set deadline may no longer be financially penalized. The Administrative Jurisdiction Division of the Council of State ruled this on Wednesday. The ruling follows an earlier decision by the European Court of Justice, which found fines and refunds to be contrary to European law.
Status holders should not be fined by default if they fail to pass their integration exam on time, the Council of State has ruled. In doing so, the highest administrative court follows an earlier ruling by the Court of Justice of the European Union, which stipulated that this is only permitted in exceptional circumstances.
