Administration Disputes Who Gets to Apply for Tariff Refunds
CBP says it has accepted $89.6 billion in claims as Judge Richard Eaton considers whether refunds must cover all importers or only litigants.
- On Tuesday, a Customs and Border Protection official testified in federal court regarding the government's plan for refunding billions of dollars in tariffs that the Supreme Court invalidated earlier this year.
- The legal battle follows a February Supreme Court decision finding President Donald Trump exceeded his authority by using the International Emergency Economic Powers Act to impose sweeping tariffs on goods from most countries.
- While the administration has directed $20.6 billion in refunds to the Treasury Department, it now aims to limit further payouts by arguing it is not required to reimburse importers whose tax bills were already finalized, or "liquidated."
- International Trade Judge Richard Eaton convened the hearing to clarify government policy, though the Federal Circuit recently suspended a requirement for CBP Commissioner Rodney Scott to appear in person.
- With more than 330,000 importers potentially eligible for refunds, companies have asked Eaton to certify a class action to simplify the process and avoid years of individual lawsuits across the legal system.
