A judge orders ICE to free a Wisconsin mosque leader, citing a ‘substantial’ free speech claim
Judge says the government did not rebut his claim that detention may have been retaliation for protected pro-Palestinian speech.
A federal judge ordered the release of Salah Sarsour, president of Wisconsin's largest mosque, from immigration detention, finding he raised a 'substantial' claim of being targeted for free speech in favor of Palestinian rights.
Sarsour's attorneys said he was targeted for speaking out against Israel, while the government claimed he is a foreign policy threat after over 30 years of legal U.S. residency.
The judge ruled there was insufficient evidence refuting Sarsour's free speech retaliation claims, and allowed him to return home while his immigration case proceeds.
