Supreme Court says Alito’s verbal reaction to Sotomayor was a ‘misunderstanding’ by Alito
Sotomayor said the ruling could block asylum applications and lead to more deaths, while Alito defended the policy from the bench.
On Thursday, Justice Samuel Alito and Justice Sonia Sotomayor engaged in a rare verbal exchange on the bench during the release of a Supreme Court opinion limiting asylum seeker entry at the southern border.
The conflict arose after the Supreme Court approved a 6-3 decision allowing border agents to turn away asylum seekers under a policy used during both President Barack Obama's and President Donald Trump's administrations.
Justice Sotomayor invoked the 1939 rejection of a Jewish refugee ship, warning the ruling could lead to deaths, while Justice Alito defended the policy as "orderly and humane" during his rebuttal.
The Supreme Court said Friday the exchange was based on a "misunderstanding," explaining Justice Alito was unaware Justice Sotomayor would verbally read her dissent before he spoke off the cuff.
This clash follows prior tensions this term, including an April apology from Justice Sotomayor to Justice Brett Kavanaugh, as the court prepares to release more high-profile rulings next week.
