- Constitutional provisions mandate that INEC examine party finances and report to the National Assembly, duties SERAP argues extend beyond simply receiving financial records from political parties under Sections 225 and 226 of the Nigerian Constitution.
- The suit seeks an order compelling INEC to release parties' audited accounts, financial statements, and details of enforcement actions taken against violations from 2023 to 2025. SERAP's lawyers include Oluwakemi Agunbiade, Kehinde Oyewumi, Andrew Nwankwo and Valentina Adegoke.
- With candidates already raising funds for the 2027 general elections, SERAP claims transparency is vital to ensuring a level playing field, as current rules remain unclear to voters and political parties.
- The suit invokes Article 9 of the African Charter on Human and Peoples' Rights and the International Covenant on Civil and Political Rights, asserting the citizen's right to information. No date has been fixed for the hearing.
