Nigeria: NMDPRA Unveils New Rules in Bid to Curb Monopoly, Market Abuse in Petroleum Sector
- The Nigerian Midstream and Downstream Petroleum Regulatory Authority unveiled 138 regulations at a stakeholders' consultation in Abuja designed to curb monopoly, abuse of market dominance, collusion and discriminatory access to critical petroleum infrastructure.
- NMDPRA Chief Executive Mallam Rabiu Umar said the framework was developed pursuant to Section 216 of the Petroleum Industry Act 2021, as liberalisation alone could not guarantee effective competition where operators control critical infrastructure.
- Under the proposed rules, owners of essential infrastructure including pipelines and storage terminals must provide access to qualified third parties on transparent, non-discriminatory terms, while competing operators face prohibitions against coordinating prices and freight charges.
- NMDPRA recently signed a Memorandum of Understanding with the Federal Competition and Consumer Protection Commission to strengthen regulatory coordination, though NMDPRA Secretary Dr Joseph Tolorunse stressed the need for clarity on concurrent jurisdiction to prevent conflicts.
- The framework grants NMDPRA enforcement powers covering market monitoring, investigations, interim measures and corrective remedies, with provisions addressing digital markets and artificial intelligence-based pricing to strengthen transparency and market efficiency.
