New York man shot by ICE officers appears in immigration court
He appeared remotely from solitary confinement as lawyers said he needs surgery to remove a bullet from his neck.
On Thursday, Oscar Belgal, 28, appeared remotely in immigration court after being shot by Immigration and Customs Enforcement officers on October 8 while driving with his 5-year-old son in New York.
Lawyers for Belgal allege masked officers in civilian clothes approached without identifying themselves and fired as he attempted to drive away; the Department of Homeland Security claims officers fired only after Belgal hit two government vehicles.
Karene Brown, of the Legal Aid Society, stated Belgal remains on 24-hour lockdown at the Metropolitan Detention Center in Brooklyn; attorneys say he requires surgery to remove a bullet lodged in his neck, though Federal officials described his injury as "superficial."
Brown requested Belgal's transfer from solitary confinement, but Judge Dara Reid stated she lacks authority over facility placement decisions; Belgal was advised by counsel not to discuss his living conditions during the hearing.
A federal judge barred Belgal's deportation Wednesday and ordered the administration to justify his continued custody; his next immigration court hearing is scheduled for October 29.
