Plans for new regulations to protect tenants in Scotland from damp and mould

New regulations will require landlords to investigate and repair damp and mould within set timescales to protect tenants, following Awaab Ishak’s death, officials said.

  • The Scottish Government proposed the Investigation and Commencement of Repair Regulations 2026, the first rules implementing Awaab’s Law to protect social and private tenants.
  • After the 2020 death of two-year-old Awaab Ishak from a respiratory condition caused by mould, public outrage prompted Awaab's Law in England, requiring quicker housing repairs, effective October.
  • Working with tenant groups, landlords and stakeholders, the Scottish Government developed rules to protect tenants and raised awareness of damp, while Mairi McAllan, Housing Secretary, said `Everyone deserves to live in a home free from damp and mould.`
  • Scots living in mould-plagued homes are set to benefit from new rules, as Michelle Wilson, tenant, David, and their nine children endured black mould for nearly 13 years.
  • In Scotland, while 90% of homes are free from damp and mould, PA Media noted the regulations will require swift investigation and prompt action by landlords, reinforcing that protective aim.
