Where a complaint against the insolvent estate of a deceased attorney was dismissed for lack of jurisdiction, a remand must be ordered because the Cranston Probate Court has jurisdiction to determine whether the appellants have asserted cognizable civil claims against the attorney’s probate estate and whether those claims should be allowed or disallowed pursuant to G.L. §§33-11-23 and 33-11-24.
