For a long time now, the fertiliser has had more nitrate in German waters than the EU has allowed. This has led to a dispute over protective measures for years. The Federal Administrative Court has now decided that the government must do more to combat nitrate.
The Federal Administrative Court enforces an action plan against too high nitrate levels in groundwater. It is a verdict against industrial agriculture and against Minister Alois Rainer. Environmentalists feel confirmed.
Since 2017, the Fertility Act has obliged the Federal Government to draw up an action plan against too high nitrate pollution in groundwater. This has not happened so far. Deutsche Umwelthilfe has now sued – and got right.
The Federal Government is losing in court. It must implement an effective nitrate action programme for water protection.
In many places, the nitrate level in groundwater is too high, which can damage health. According to a ruling, the government must now take action against pollution.


The Federal Administrative Court of Leipzig is forcing the Federal Government to do more to combat nitrate pollution in groundwater. The legislator must now improve – the time for half-hearted compromises is over.
