Judge denies Lindsay Clancy's long-shot bid for not guilty finding in children's deaths
Judge William Sullivan said physical and circumstantial evidence was enough for a jury to weigh Clancy’s criminal responsibility in the children’s deaths.
- On Thursday, Judge William Sullivan denied a motion that would have found Defendant Lindsay Clancy not guilty in the murder of her three children, ruling that prosecutors presented evidence "sufficient" to send the case to a jury.
- Following a mistrial declared Sept. 4 after jurors deadlocked 11-1 in favor of acquittal, defense attorney Kevin Reddington unexpectedly reversed his April position and argued Tuesday that prosecutors failed to prove Clancy caused the deaths.
- Reddington claimed prosecutors did not prove "that she was not acting at the time of the psychosis and should be found not guilty," while Judge Sullivan noted GPS data and surveillance footage confirmed Clancy was the only person home when her children were killed.
- The defense team has filed additional motions asking the court to investigate a so-called "lone holdout" juror and to dismiss the case on "double jeopardy" grounds ahead of a potential retrial, with the next hearing scheduled for Nov. 2.
