MARYLAND, UNITED STATES, AUG 8 – The nationwide injunction protects citizenship rights of children born after February 19, 2025, to parents living illegally or temporarily in the U.S., according to multiple court rulings.
- Shortly after the Supreme Court's June ruling, a New Hampshire court paused President Trump’s birthright citizenship order, the fourth nationwide injunction since June.
- U.S. District Judge Deborah Boardman blocked President Trump's birthright citizenship order, with the order stating U.S. citizenship should not automatically apply to those born to parents living illegally or under temporary status, effective January 20, 2025.
- Class certification followed Boardman's finding that plaintiffs are extremely likely to win their 14th Amendment challenge and face irreparable harm.
- Amid months of legal back-and-forth, the birthright citizenship policy remains blocked after the 4th U.S. Circuit Court of Appeals sent the case back to Boardman Thursday.
- Despite the June Supreme Court ruling, in a 6-3 decision, the Court narrowed injunctions against the order without letting it take effect, and the case was returned to the 4th U.S. Circuit Court of Appeals.
