Iowa lawsuit says sheriff discouraged compliance with immigration law

- The post in question stated that the sheriff's department doesn't always need to detain people at the request of federal immigration authorities, specifically U.S. Immigration and Customs Enforcement , despite the sheriff's office having responded to nearly two dozen ICE requests to hold individuals suspected of immigration violations since 2018.
- Sheriff Marx stated on February 4 that he shares constituents' mistrust and concerns with the legitimacy of federal agents' business, arguing that requests to hold individuals without a court order clash with the Fourth Amendment, which bars unreasonable searches and seizures, and he wrote, 'If federal agents' actions or paperwork are not within constitutional parameters, then we will make every effort to block, interfere and interrupt their actions from moving forward.'
- Hours after the lawsuit was filed, the sheriff's office deleted the February post to 'demonstrate good faith' while reiterating its commitment to compliance with state and federal immigration laws and constitutional protections, although they 'disagree with the Attorney General's conclusion' that the original post broke the law.
