The Bavarian Administrative Court decided yesterday in the urgent procedure that the ban on cannabis use in the northern part of the English Garden in Munich will be lifted and that the Bavarian Park Ordinance is invalid in this respect. Thus, the court granted an application, which a cannabis patient and a consumer with the support of the German Hemp Association (DHV) had submitted.
The German Hemp Association (DHV) plans to file a constitutional complaint against the Bavarian Health Protection Act (GSG) with the Federal Constitutional Court on Wednesday. As the DHV announced on Monday, a declaratory action against the GSG is also expected to be filed with the Munich Administrative Court on the same day.
