Virginia Lawmakers Defend Cannabis Budget Language
The Code Commission said current penalties remain in effect until July 1, 2027, after lawmakers left a gap in the cannabis budget language.
On Wednesday, the Virginia Code Commission updated the online state code to clarify that existing marijuana penalties remain in effect until the state's retail cannabis market launches on July 1, 2027.
Ambiguous budget language, drafted when lawmakers revived adult-use cannabis retail through the budget rather than standalone legislation, led prosecutors and police to question if criminal statutes were accidentally repealed before the 2027 market launch.
Del. Paul Krizek and Sen. Lashrecse Aird rejected claims that the budget legalized underage distribution, while Williamsburg-James City Commonwealth's Attorney Nate Green said the unclear wording "invites an argument" about which laws remain enforceable.
Virginia State Police Superintendent Jeffrey Katz stated that officers will "continue to enforce existing laws," countering an internal directive that had briefly paused cannabis-related enforcement following the July 1, 2026 budget enactment.
The Code Commission utilized its authority to resolve the discrepancy, preventing what chair Del. Marcus Simon described as an "absurd result" where the state would have functioned without enforceable marijuana laws.
