Cowichan’s lawyer says B.C. must reconcile property rights with land claim ruling
BRITISH COLUMBIA, CANADA, AUG 11 – The B.C. government appeals to protect private property rights after the Quw'utsun Nation won fishing rights and land title on Lulu Island, citing concerns over legal precedents, Attorney General said.
- On Aug. 11, the B.C. Supreme Court decision, which is under appeal, granted the Quwʼutsun Nation fishing rights and title over Lulu Island, declaring existing land titles defective and invalid.
- As part of its case, the Quwʼutsun Nation argued it once had a semi-permanent village at Lulu Island, supporting its land claim.
- Attorney General Niki Sharma said `We disagree strongly with the decision` and warned of `significant unintended consequences` for private property rights.
- The British Columbia government will seek an appeal and a stay to pause implementation until the case is reviewed, Attorney General Niki Sharma announced.
