Fundamental Rights Suit: Court Dismisses El-Rufai’s Suit Seeking To Stop ICPC, EFCC From Freezing Assets
Justice Joyce Abdulmalik ruled the filing was an abuse of court process after El-Rufai brought similar cases in two courts, the ICPC said.
- On Thursday, the Federal High Court in Abuja dismissed a suit by former Kaduna State Governor Nasir El-Rufai seeking to restrain the Independent Corrupt Practices and Other Related Offences Commission from freezing his bank accounts.
- Justice Joyce Abdulmalik dismissed the case as an abuse of court process, ruling that El-Rufai had filed similar suits in the FCT High Court and FHC within 12 days, creating risk of conflicting judgments.
- El-Rufai sought a perpetual injunction protecting accounts at Zenith Bank, Guaranty Trust Bank, and Access Bank, while demanding N1 billion in damages for alleged psychological trauma and reputational harm from the threatened asset freezing.
- Ruling that they were not necessary parties, the court struck out the Economic and Financial Crimes Commission , Department of State Services , and Attorney-General of the Federation from the respondents.
- The ICPC maintained that granting the injunction would impede its ongoing criminal investigation, arguing that asset tracing and freezing stemmed from a singular, continuous, and lawful inquiry into El-Rufai's finances.
