Court says Border Patrol official won’t have to brief judge on Chicago-area immigration sweeps
- On Friday, the 7th U.S. Circuit Court of Appeals granted the government's petition for mandamus and stayed the order requiring Border Patrol Commander Gregory Bovino to report daily.
- U.S. District Judge Sara Ellis on her own motion issued daily-appearance orders after a temporary restraining order earlier this month, citing videos that raised doubts about TRO compliance amid Chicago-area protests.
- During a Tuesday witness session, Ellis ordered Gregory Bovino, Border Patrol Commander, to get a personal body camera and provide every use-of-force report since Operation Midway Blitz began.
- The appeals panel ruled that the 7th U.S. Circuit Court of Appeals stayed Ellis's order two hours before Bovino's first scheduled appearance, saying it would intrude on Executive Branch decisions and infringe separation of powers.
- The litigation centers on the Broadview processing center as advocates have for months raised concerns about cramped, unsanitary conditions holding up to 200 people without counsel.
