- While the panel majority acted to "prevent anarchy," head of the panel Abba Mohammed delivered a dissenting judgment, arguing the dispute concerned internal party affairs that were non-justiciable and outside the court's jurisdiction.
- The court noted that appellants failed to rely on recent Supreme Court rulings regarding the Peoples Democratic Party , which confirmed that courts may intervene when political parties violate their own constitutional and statutory provisions.
