Boy Who Died on River Tay 'Could Not Swim More than 33ft Unaided'
A 12-year-old non-swimmer was allowed to participate in riverboarding despite safety warnings; Outdoor Pursuits Scotland admitted a health and safety breach and was fined £10,000.
- A Fatal Accident Inquiry at Falkirk Sheriff Court is examining the deaths of 12-year-old Kayden Walker and outdoor pursuits instructor Ruaridh Stevenson, who drowned during separate water-based activity events.
- Kayden Walker, who could not swim more than 10m without flotation, died while riverboarding on the River Tay in July 2019; Outdoor Pursuits Scotland Ltd later admitted breaching health and safety legislation and received a £10,000 fine.
- Angela Molloy, a former Church House project manager, testified she relied on Outdoor Pursuits Scotland Ltd to ensure safety but did not see warning signs reading "Deep water, strong currents, no swimming" near the river.
- Molloy told the court that Church House still permits non-swimmers to participate in water activities if suppliers deem it safe, stating, "After the incident, if the organiser says they don't need to be able to swim, then we still take them out on the water."
- The inquiry, overseen by Sheriff Keith O'Mahony, will hear evidence regarding both incidents over 10 days or more to determine circumstances surrounding these deaths and identify reasonable precautions to minimize risks in future situations.
