Australian Court Rejects Convicted Murderer's Appeal of Deportation to Small Island Nation
Seven judges rejected TCXM’s challenge, clearing the way for Australia’s first deportations under a new 30-year resettlement deal with Nauru.
On Wednesday, the High Court of Australia unanimously upheld the deportation order for TCXM, an Iranian man, to Nauru, ending his legal challenges to remain in Australia.
TCXM arrived from Iran in 1990 and received a protection visa in 1995, but his visa was canceled in 2015 after he served 22 years for murdering his wife, triggering eight years in immigration detention.
Under a resettlement agreement, Australia pays Nauru $70 million annually to house unwanted non-citizens under 30-year visas for those unable to return to their homelands.
Immigration Minister Tony Burke applauded the ruling, stating, "A cancelled visa must have consequences in our migration system," as the government asserts control over immigration policy.
Following a 2023 High Court ruling that found indefinite detention illegal for stateless individuals, more than 350 people including TCXM were released on temporary visas.
