Federal Judge in Oregon: Homeland Security ‘Tricked’ Asylum Seeker Before Arrest at Immigration Court
MULTNOMAH COUNTY, OREGON, JUL 15 – The judge found that ICE violated the asylum seeker's rights by detaining her despite claims of persecution and assault, ordering her release after 43 days in custody.
- In Portland, a federal judge ordered O-J-M’s immediate release, citing unlawful detention by ICE and violations of her rights.
- Her attorneys filed a habeas petition Monday, arguing her due process rights were violated, after ICE agents detained O-J-M on June 2, 2025, and Judge Baggio questioned the legality and noted she was misinformed.
- She was deceived into accepting dismissal of her case before the Portland Immigration Court so that masked agents could arrest her immediately and detain her in Tacoma, Jordan Cunnings, legal director at Innovation Law Lab, said.
- Following the order, attorneys for O-J-M said she is now out of detention, and the group praised the court’s recognition of her rights.
- Looking ahead, Innovation Law Lab will appeal to the Board of Immigration Appeals, as Cunnings highlighted government procedural errors and violations of due process.
