7-Eleven Sues Nike over Sneakers that Look a Little Too Familiar, Representatives Share
7-Eleven says Nike’s Air Max 95 uses a confusingly similar stripe pattern and could mislead consumers about sponsorship, according to the lawsuit.
On Wednesday, 7-Eleven sued Nike in Texas federal court, alleging the sportswear giant copied its signature orange, green, and red stripe design on an upcoming Air Max 95 sneaker set to release July 11.
Nike scheduled the shoe's release for July 11, the date the retailer celebrates "7-Eleven Day" and "Free Slurpee Day," leading 7-Eleven to claim consumers will mistakenly believe the product is an official endorsement.
The lawsuit cites "brazen allusions" to the retailer, including store shelf graphics and a reference to "strolling down to the corner store" in marketing, despite the two companies exploring a collaboration as recently as 2020.
7-Eleven is seeking a court order to block Nike sales, recall existing stock, and destroy marketing materials, while the sneaker's product page on the company's website currently returns a 404 error.
Claiming "Nike's infringement is a deliberate and willful effort," the retailer argues the "Infringing Footwear" misuses its "Tri-Color Mark," while aftermarket prices for the shoe have doubled following the lawsuit's filing.
