Udhayanidhi Stalin’s ‘eradicate Sanatana’ remark implies genocide, says Madras HC, quashes FIR against Amit Malviya
- The Madurai Bench of the Madras High Court quashed the 2023 FIR filed by Tiruchi city police against BJP leader Amit Malviya on Tuesday.
- In his post on X, Malviya alleged the minister called for the 'Genocide of 80% of the population of Bharat' and questioned the media-reported speech.
- The judge zeroed in on the Tamil word ozhippu, noting it means eradication rather than opposition, and Justice S. Srimathy found Udhayanidhi Stalin's analogy to mosquitoes and disease amounted to hate speech.
- The judge concluded the reply post was a question not attracting IPC provisions, and the court ruled continuing the case would abuse process and cause irreparable harm to the petitioner .
- The court placed the remarks in a longer history, noting a century-long pattern of the Dravidar Kazhagam and Dravida Munnetra Kazhagam making statements against Sanatana Dharma and that no state-level case exists against the minister though some cases are filed in other states.
