Setback for CM Vijay? Madras HC Restraints Tiruppattur TVK Candidate From Assuming Office as MLA over ‘1 Vote Win’ Row
The court said the disputed postal ballot could have forced a tie and a draw of lots under election rules.
- On Tuesday, the Madras High Court restrained TVK MLA Seenivasa Sethupathy from participating in Wednesday's Legislative Assembly trust vote, preventing him from any voting proceedings.
- Former DMK Minister Periakaruppan challenged the election result, alleging a postal ballot intended for Tiruppattur in Sivaganga district was misdirected to Tirupattur district, costing him the seat by one vote.
- Periakaruppan secured 83,374 votes against Sethupathy's 83,375. The ECI argued that under Article 329 of the Constitution, "no election shall be called into question" except through an election petition.
- Authorities were directed to preserve all election records, CCTV footage, and the disputed postal ballot. The Bench clarified the order does not invalidate Sethupathy's election or grant rights to Periakaruppan.
- With the main petition listed for June 26, the interim injunction remains in effect, barring Sethupathy from the trust vote and impacting the newly formed TVK government's floor test.
