Green Card Update as Marco Rubio Ordered to Reopen 2027 Lottery
The ruling lets up to 55,000 applicants worldwide enter the lottery after the administration missed the registration deadline.
- On Wednesday, U.S. District Judge Jinsook Ohta ordered the U.S. Department of State to reopen the 2027 Diversity Immigrant Visa Program. Secretary of State Marco Rubio must announce the registration period by midnight October 29.
- Red Eagle Law, a California immigration firm, sued the administration in August, arguing the government's failure to open registration on time violated federal law. The Trump administration had previously argued it was too late to implement the program.
- Mandated by the court, the registration period must remain open for 30 days starting by November 1. The program, created by the Immigration Act of 1990, allows up to 55,000 individuals to receive lawful permanent residency.
- Following the ruling, attorney Curtis Morrison said "We won," arguing that the administration cannot ignore laws passed by Congress. He emphasized the judiciary's role in enforcing statutory requirements.
- Although the Trump administration has long opposed the program, calling it "the worst of the worst," the State Department must now process applications until the 55,000 visa allocation is exhausted or until September 30, 2027.
