Top court sets sentencing framework for cases involving Indigenous offenders, victims
The Supreme Court of Canada ruled that judges must balance sentencing principles for Indigenous offenders and Indigenous victims when an Indigenous offender harms an Indigenous intimate partner.
In a 5-4 decision, the court created a framework for sentencing in these cases.
The court said Indigenous people face disproportionate imprisonment, while Indigenous women and girls experience high levels of violence and abuse, issues shaped by colonization.
The ruling upheld a three-year sentence for a Mi’kmaq man who pleaded guilty to aggravated assault against his Mi’kmaq partner.
The Supreme Court of Canada states that in cases where an Aboriginal offender commits an offence against an intimate partner who is an Aboriginal woman, the judge must apply the sentencing principles applicable to both Aboriginal offenders and victims of crime in a harmonious manner.
