Second federal judge freezes Trump mail ballot order with US Supreme Court poised to weigh in
The ruling adds another obstacle to the administration’s effort to rewrite election rules as the Supreme Court weighs the Postal Service appeal.
- Late Sunday, District Judge Carl Nichols in Washington blocked the United States Postal Service from enforcing President Donald Trump's new mail-ballot regulations, adding another hurdle as the Supreme Court considers a similar case.
- Stemming from an executive order President Trump issued earlier this year, the regulations mandate pre-approval for ballot envelope designs and a new online portal, which the union representing United States Postal Service workers opposes.
- "Plaintiffs have demonstrated that, absent an injunction, there is an increased risk that a significant number of otherwise appropriate absentee or mail-in ballots will ultimately not be counted," Nichols wrote, while a whistleblower report to Congress warned of potential mass disenfranchisement.
- With mail ballots already being distributed in Alabama, North Carolina, and Wisconsin, election officials argue the changes are impossible to implement so close to the general election.
- The Supreme Court is currently considering an appeal regarding a similar ruling by District Court Judge Indira Talwani in Boston, as President Trump has long falsely blamed mail balloting for his 2020 loss to Democrat Joe Biden.
