Patrick Clancy Lawyers in Court as Lawsuit Against Lindsay Clancy’s Medical Providers Continues
Patrick Clancy says medical providers overmedicated his ex-wife and failed to monitor her care, a claim tied to the deaths of their three children.
On Wednesday, Norfolk Superior Court Judge Michael Doolin heard arguments in Patrick Clancy's wrongful death lawsuit against medical providers who treated his ex-wife, Lindsay Clancy, before their children's 2023 deaths.
Patrick's lawsuit alleges Dr. Jennifer Tufts and Nurse Practitioner Rebecca Jollotta committed a "catastrophic failure" in monitoring Lindsay's mental health and prescribing medications that triggered a psychotic break.
Attorney Howard Cooper argued Lindsay will testify she communicated "homicidal ideation" to providers, though her criminal defense lawyer Kevin Reddington disputed this, stating she never indicated she would testify in the civil suit.
Defense attorneys Timothy Sweetland and Mary Alys Azzarito argued their clients are immune under state law, asserting Lindsay never made explicit threats required for provider liability under the "duty to warn" statute.
Judge Doolin took the motion to dismiss under advisement without issuing a ruling, while Plymouth District Attorney Timothy Cruz continues to decide whether to pursue a criminal retrial for Lindsay.
