CDL Rule Change Draws 8,000 Comments on Immediate Licensing Reforms

- On Nov. 28, the Federal Motor Carrier Safety Administration closed a two-month comment period with more than 8,000 submissions on its emergency interim rule to remove nearly 200,000 non-domiciled CDLs.
- Transportation Secretary Sean Duffy framed the action as a 'national emergency' and FMCSA said inconsistent state licensing allowed unqualified drivers, causing fatal crashes.
- FMCSA's interim rule removes the EAD as sufficient proof for a non-domiciled CDL, limiting eligibility to lawful-status holders and H-2A, H-2B and E-2 visa categories, excluding asylum seekers, asylees, refugees and Deferred Action for Childhood Arrivals recipients.
- Thousands of the comments were submitted by truck drivers who would lose CDLs, enforcement is paused and litigation awaits FMCSA's review, while litigants sought a court invalidation to prevent devastating consequences.
- Owner-Operator Independent Drivers Association said more action is needed to verify safety, competency and integrity at initial access points, backing the interim rule but urging complete driving histories and audits.
