Trans row nurse Sandie Peggie appeals tribunal ruling on discrimination case
Her lawyers will take the case to the Employment Appeal Tribunal after a judge dismissed all three discrimination claims against the union.
On Monday, employment judge Sangster dismissed Sandie Peggie's direct discrimination claims against the Royal College of Nursing. The 37-page judgment concluded the union's actions were not influenced by Peggie's protected beliefs.
Peggie brought this case against the RCN, alleging the union failed to provide legal assistance or seek assurances regarding single-sex space policies during her dispute with NHS Fife.
The legal conflict stems from a December 2023 incident at Victoria Hospital, where Peggie shared a changing room with Beth Upton. A separate 2025 tribunal previously upheld harassment claims against NHS Fife.
Following advice, Peggie's legal team announced Wednesday that she will appeal the tribunal's judgment. The notice of appeal is expected to be submitted to the Employment Appeal Tribunal within the coming week.
"Given that the appeal process will shortly be under way, no further comment will be made at this stage," the legal team stated. Peggie remains grateful for the support received throughout the proceedings.
