Land commission denies subdivision of ‘Rust Valley Restorers’ property in Shuswap

The commission said sole title and building changes do not justify splitting the three-hectare ALR parcel.

  • To offset the subdivision, applicants proposed moving 1.54 ha of land at 1715 Chase-Falkland Road into the Agricultural Land Reserve. Hall also stated his intention to change one of the restoration shops into a residence and use the other for agricultural storage.
  • While the Commission found the 1715 Chase-Falkland Road land has prime agricultural capability, the Okanagan Panel advised that the proposed subdivision would not remedy any of the unauthorized uses on the property, ultimately refusing the proposal.
  • Enforcement for 2 years was previously deferred by the Okanagan Panel until May 29, 2025, to allow time for non-farm uses to be relocated. The ALC has denied several requests for reconsideration regarding the property within the Columbia Shuswap Regional District.
