Former Patient Sues Sen. Roger Marshall Over Alleged Illegal Interest Rates on Medical Debt
The complaint says Marshall and Heartland Regional OBGYN charged 18% interest on unpaid bills, above Kansas’ legal cap, and seeks class certification and damages.
A class action lawsuit filed Thursday in Barton County District Court accused U.S. Senator Roger Marshall and his former medical practice, Heartland Regional OBGYN, of charging patients illegal 18% interest rates on unpaid medical debt, exceeding Kansas' 15% statutory limit.
Lead plaintiff Meischa Zimmerman alleges Heartland sued her over a $3,596 bill for her child's delivery, with debt collection efforts leading to her arrest on three separate occasions. The practice filed more than 700 such lawsuits against former patients.
Attorney Kent Roth described the 18% interest rate as "unmitigated greed and blatantly unlawful," pointing to Kansas law prohibiting rates above 15%. Other regional medical practices historically set interest rates at 10% before judgment and 12% after.
The lawsuit adds pressure to Marshall's contest against Democratic opponent Adam Hamilton, as the Cook Political Report recently shifted the Senate race to a toss-up column amid the allegations.
As Election Day approaches on November 3, 2026, President Donald Trump will hold a campaign rally in Salina, Kansas, on Sunday to support the incumbent. Recent polling indicates the competitive contest remains highly fluid.
